
Terms and Conditions
Please read these terms carefully before using our services
This agreement is not an insurance policy; it is a Service Contract between You and LuxGuard. All obligations and liabilities for repairs covered by this Service Contract are those of LuxGuard. In return for payment by You of the Service Contract Price and subject to all the terms of this Service Contract, We agree with You as follows. This Service Contract provides mechanical breakdown protection and is between the Service Contract Holder ("You", "Your") and the Service Contract Provider ("We", "Us", "Our", "LuxGuard"). The Administrator is authorized to perform administrative services on Our behalf.
1. Key Terms and Definitions
When used, Key Terms will appear in bold print:
- "Provider", "We", "Us" and "Our" mean the Selling Dealer shown on the Information Schedule.
- "Administrator" means First Extended Service Corporation, except in California where Administrator means First Extended Service Corporation dba First Extended Insurance Service, California License #0E32800, all located at P.O. Box 804785, Chicago, Illinois 60680-4109, 1-800-527-3426.
- "Breakdown" means the failure of any original or like replacement part covered by this Service Contract to perform its intended function(s) in normal service, providing it has received all scheduled maintenance as recommended by the manufacturer in the Owners Manual. Breakdown does not include the gradual reduction in operating performance caused by wear and tear where a failure has not occurred.
- "Cost" means the reasonable and customary charges for parts and labor necessary to repair or replace the parts covered. These charges shall not exceed the manufacturer's suggested retail price for parts and labor allowances derived from nationally recognized labor time publications. At the Administrator's option, replacement parts used in covered repairs may include new, remanufactured, used or non-original equipment manufactured parts.
- "Deductible" means the amount You must pay per visit for covered repairs shown on the Information Schedule. If the optional Disappearing Deductible box is checked, the Deductible is $0 when covered repairs are performed at the Selling Dealer and the indicated Deductible amount on the Information Schedule when performed elsewhere.
- "In-Service Date" means the Vehicle's factory Warranty start date or the Vehicle's first day of use, whichever occurs first, regardless of the Service Contract Purchase Date.
- "Miles" means the number of miles for the Service Contract Term shown on the Information Schedule.
- "Months" means the number of months for the Service Contract Term shown on the Information Schedule.
- "Repair Facility" means a franchised automobile dealer or licensed repair facility that provides a written parts and labor guarantee for covered repairs of not less than six (6) months and six thousand (6,000) miles. Repairs performed by any facility must receive authorization from the Administrator prior to beginning repairs.
- "Selling Dealer" means the dealer from whom You purchased this Service Contract shown on the Information Schedule.
- "Service Contract Price" means the amount You paid for this Service Contract shown on the Information Schedule.
- "Service Contract Purchase Date" means the date You purchased this Service Contract shown on the Information Schedule.
- "Vehicle" means the covered vehicle shown on the Information Schedule.
- "Warranty" means any Warranty of the manufacturer, state required Warranty, dealer Warranty or a Repair Facility guarantee.
- "You" and "Your" mean the customer shown on the Information Schedule, or an eligible person to whom this Service Contract has been properly transferred.
2. Agreement to Terms
By accessing and using LuxGuard's services, you agree to be bound by these Terms and Conditions. If you disagree with any part of these terms, you may not access our services.
This Service Contract is subject to the following conditions:
- The Service Contract must be purchased within the mileage and time parameters shown on the Information Schedule.
- The Vehicle must have a valid and current registration.
- The Vehicle must have a valid Vehicle Identification Number (VIN).
- The Vehicle must be operable and in good condition at the time of Service Contract purchase.
- Any material misrepresentation made by You may result in cancellation of this Service Contract.
3. Warranty Coverage
Our warranty coverage is subject to the following conditions:
- Vehicle must be inspected by an authorized mechanic prior to coverage activation
- Regular maintenance must be performed as specified in the manufacturer's maintenance schedule
- Claims must be submitted within 30 days of the Breakdown occurrence
- Coverage is limited to specified components and systems as detailed in your Service Contract
- Coverage begins on the Service Contract Purchase Date and expires when either the specified months or mileage is reached, whichever occurs first
- All repairs must be performed by an authorized repair facility unless otherwise approved by the Administrator
Coverage Plans
We offer the following coverage plans. Your Information Schedule shows which coverage You have purchased:
Power Train Coverage Plan
- Engine: All internally lubricated parts including: pistons, piston rings, piston pins, crankshaft and main bearings, connecting rods and rod bearings, camshaft and camshaft bearings, timing chain and timing gears, intake and exhaust valves, valve springs, oil pump, push rods, rocker arms, hydraulic lifters, rocker arm shafts and cylinder head bolts. The engine block and cylinder heads are also covered if damage is caused by the failure of an internally lubricated part.
- Transmission: All internally lubricated parts contained within the transmission case including: oil pump, drums, planetaries, sun gear and shell, shaft(s), bearings, shift rail, forks, and synchronizers. The transmission case is also covered if damage is caused by the failure of an internally lubricated part.
- Drive Axle: All internally lubricated parts contained within the drive axle housing including: carrier case, gear sets, bearings, axle shafts, differential, and universal joints. The drive axle housing is also covered if damage is caused by the failure of an internally lubricated part.
- Hybrid/EV Components: Electric motor, power controller, inverter assembly, generator, drive motor dampener, electronic transmission, electronic power steering pump, electronic water pump and electronic brake vacuum pump.
Base Coverage Plan
Includes Power Train Coverage plus:
- Steering: All internally lubricated parts contained within the steering gear box and pump housing, including: rack and pinion, control valve, steering main and intermediate shafts, power cylinder assembly, power steering pump, and tie rod ends.
- Suspension: Upper and lower control arms, control arm shafts and bushings, upper and lower ball joints, steering knuckles, stabilizer shaft, stabilizer linkage, stabilizer bushings, wheel bearings, MacPherson strut upper mount/bearing plate, strut insert cartridge, spindle, and spindle support.
- Brakes: Master cylinder, power brake booster, wheel cylinders, hydraulic lines and fittings, disc brake calipers, ABS electronic control module, ABS hydraulic control unit, ABS hydraulic control unit seals, ABS pump motor assembly, and wheel speed sensors.
- Electrical: Alternator, voltage regulator, starter motor, starter solenoid, distributor, engine control module (ECM), ignition coil, ignition switch, front and rear window wiper motors, washer pump and switch, stop lamp switch, headlamp switch, turn signal switch, heater/AC blower speed switch, manual heater/AC control head, horns, and cruise control module.
- Air Conditioning: Compressor, compressor clutch and pulley, condenser, evaporator, accumulator, receiver dryer, temperature control programmer, power module, blower motor, and heater control valve.
High-Tech Coverage Plan
Includes Base Coverage plus:
- Advanced Safety Systems: Automatic emergency braking sensors and cameras, collision avoidance sensors, collision avoidance cameras, collision avoidance radar units, brake pedal position sensor, lane departure warning system, back-up sensors, back-up camera, heads up display projector and display module, blind spot monitoring sensors and cameras.
- Power Accessories: Power window motors/regulators, power door lock actuators, power trunk release actuator, power seat motors, power mirror motors, power antenna motor, convertible top motor, sunroof motor.
- Electronics: Engine control module, transmission control module, body control module, suspension control module, cruise control module, transfer case control module, electronic instrument cluster, electronic climate control head, electronic climate control module, anti-theft control module, keyless entry control module.
- Navigation/Audio: Factory-installed GPS navigation system display, GPS navigation system control module, GPS navigation system antenna, factory-installed audio system head unit, factory-installed audio system amplifier, factory-installed audio system speakers, factory-installed audio system subwoofer, factory-installed audio system equalizer, factory-installed satellite radio receiver.
- Sensors: Mass air flow sensor, crankshaft position sensor, camshaft position sensor, throttle position sensor, oxygen sensor, coolant temperature sensor, knock sensor, oil pressure sensor, vehicle speed sensor, steering angle sensor, yaw rate sensor, manifold absolute pressure sensor.
Comprehensive Coverage Plan
Our most complete coverage that includes:
- All components covered in the High-Tech Coverage Plan
- All factory-installed mechanical and electrical components except those specifically listed under "What Is Not Covered"
- Seals and gaskets for all covered components
- Enhanced electrical system coverage including wiring harnesses and connectors
- All factory-installed Advanced Driver Assistance Systems (ADAS) components
- All sensors and control modules for vehicle operation and safety systems
- All factory-installed convenience and luxury feature components
- All factory-installed entertainment and communication system components
Additional Benefits
1. Rental Reimbursement
When a Breakdown renders Your Vehicle inoperable or unsafe to drive and requires Your Vehicle to be held by a Repair Facility overnight for covered repairs, We will pay Your actual expenses to rent a replacement vehicle from a licensed rental agency not to exceed $35 per day for a maximum of five (5) days for any one Breakdown.
2. Emergency Roadside Assistance
Available 24 hours a day, 365 days a year. We will pay for covered emergencies up to $100 per occurrence. The following services are covered:
- Towing Assistance: When Your Vehicle is inoperable or unsafe to drive, it will be towed to the closest Repair Facility or any location You request
- Flat Tire Assistance: Service consists of removal of the flat tire and its replacement with Your spare tire
- Fuel, Oil, Fluid and Water Delivery: Emergency supply delivery if Your Vehicle is in immediate need (You pay for the supplies)
- Lock-out Assistance: Help with gaining entry if Your keys are locked inside Your Vehicle
- Battery Assistance: Jump-start service if battery failure occurs

3. Emergency Travel Expense Reimbursement
We will pay for emergency local commercial lodging, meals, and transportation expenses up to $200 per day (maximum 5 days) when:
- The Breakdown occurs 100 miles or more from Your home
- The Breakdown renders Your Vehicle inoperable or unsafe to drive
- Your Vehicle must be held overnight by a Repair Facility for covered repairs
4. Manufacturer's Deductible Reimbursement
When a Breakdown of a covered part occurs which is also covered by a manufacturer's warranty, We will reimburse You for the difference between the Deductible amount shown on the Information Schedule and the manufacturer's deductible.
4. What Is Not Covered
Maintenance and Parts Not Covered
- The maintenance services and parts described in the manufacturer's maintenance schedule for Your Vehicle
- Engine tune-up components including spark plugs, glow plugs, ignition wires, distributor cap and rotor
- All batteries including lithium-ion battery
- Filters, lubricants, fluids, air conditioning refrigerant, engine coolant
- All hoses and belts not specifically listed
- Brake pads, shoes, rotors, and drums
- Suspension alignment, CV boots, tires, wheel covers, rims, balancing
- Exhaust system, catalytic converter, vehicle charging station
- Glass, glass framework, fastening adhesives, sealed beam head lamps
- Trim, moldings, bright metal, upholstery, paint, sheet metal
- Body panels, structural framework, door panels, bumpers
Additional Exclusions
- Costs covered by any warranty regardless of whether they honor such warranty
- Any costs that would have been covered under any vehicle manufacturer warranty
- Vehicles declared a total loss, salvaged, or junk vehicle
- Repairs performed without prior authorization (except emergency repairs)
- Breakdowns caused by contamination, overheating, lack of coolant or lubricants
- Breakdowns due to collision, fire, theft, vandalism, riot, weather, or natural disasters
- Vehicles used for racing or competition
- Modifications not performed by the manufacturer
- Vehicles modified to plow snow
- Consequential damages from collision involving a covered component
- Cosmetic imperfections
- Breakdowns caused by abuse, misuse, or lack of maintenance
- Breakdowns caused by rust or corrosion
5. Maintenance Requirements
In order to keep Your Service Contract valid, Your Vehicle must be serviced receiving all scheduled maintenance as recommended by the Manufacturer in the Owner's Manual. If You do not have an Owner's Manual, contact Your Vehicle manufacturer to obtain a maintenance schedule.
Required Documentation
You must keep and be able to provide the following documentation when requested:
- Receipts showing the Vehicle Identification Number
- Detailed work orders for all maintenance performed
- Description of services performed
- Date and mileage at the time of service
- Proof that the specified services have been performed
Failure to show proof of servicing may result in the denial of coverage.
6. Claims Process
Initial Steps for Repairs
- If Your Vehicle is within forty (40) miles of the Selling Dealer, You must deliver Your Vehicle to the Selling Dealer
- If Your Vehicle is more than forty (40) miles from the Selling Dealer or if the Selling Dealer is no longer at that address, call the Administrator for instructions before delivering Your Vehicle to a Repair Facility
- Authorize the Repair Facility to perform necessary diagnostic work
- To ensure coverage, authorization must be obtained prior to repair

Emergency Repair Instructions
In the event that a Breakdown of a covered part occurs when the Administrator's office is closed and emergency repairs are necessary:
- You may proceed with emergency repairs without prior authorization
- You or the Repair Facility must notify the Administrator of the repairs as soon as the Administrator's office reopens
- Submit written information and documentation concerning the Breakdown and repairs no later than thirty (30) days after the Breakdown
- Emergency repairs are those required because Your Vehicle was inoperable or unsafe to drive
- Parts must be available for inspection when the Administrator's office reopens
Your Responsibilities During Claims
- Use all reasonable means to protect Your Vehicle from further damage
- Notify the Administrator as soon as possible if You cannot return to the Selling Dealer
- Authorize diagnostic work for accurate repair estimates
- Provide proof of maintenance if requested
- Allow the Administrator to inspect Your Vehicle if requested
- Cooperate with the investigation of any claim
IMPORTANT: We will not pay for diagnosis charges for repairs not covered under this Service Contract.
7. General Provisions
Service Contract Term
- For New and Pre-Owned Vehicles: The Service Contract begins on the Service Contract Purchase Date and ends when either the specified Months from the Purchase Date is reached or when the specified Miles from the Current Odometer Reading are registered, whichever occurs first.
- For New and Certified Pre-Owned Vehicles: The Service Contract begins on the Service Contract Purchase Date and ends when either the specified Months from the In-Service Date is reached or when the specified Miles from zero miles are registered, whichever occurs first.
Coverage Area
This Service Contract applies only to Breakdowns occurring within the continental United States of America, Alaska, Hawaii and Canada.
Other Coverage
If the manufacturer or Repair Facility agrees to cover all or some of the Cost of a Breakdown after a Warranty or guarantee has expired, We will pay only for any extra Cost. This applies to any Rental Reimbursement, Emergency Roadside Assistance or Emergency Travel Expense Reimbursement coverage You may have.
Limit of Liability
Our limit of liability is the Cost to repair or replace any covered Breakdown; but in no event shall this Cost exceed the average retail value of Your Vehicle as determined by the NADA Official Used Car Guide at time of loss.
8. Cancellation Policy
You may cancel your warranty at any time:
- Within 60 days of purchase with no claims: 100% refund of the Service Contract price
- After 60 days or with claims filed: Pro-rated refund based on time or mileage remaining, minus a $50 administrative fee
- To cancel, contact the Selling Dealer or provide written notice to the Administrator
- Refunds will be paid to the Lienholder if applicable, otherwise to You
We may cancel this Service Contract with 30 days written notice for reasons including material misrepresentation, failure to maintain your vehicle, non-payment, or use of the vehicle in a manner not covered by the Service Contract.
9. Transfer of Warranty
Your rights under this Service Contract may be transferred once to a subsequent purchaser within 15 days from the date of sale. To transfer, submit the completed Transfer Request form, a copy of the Service Contract, bill of sale showing the date of transfer, and a $50 transfer fee to the Selling Dealer.
10. Payment Terms
Warranty coverage begins upon full payment and completion of the vehicle inspection. Monthly payment plans are available subject to credit approval. If the Service Contract is financed, the Lienholder may cancel the contract in the event of default or if the vehicle is declared a total loss or repossessed.
11. Communications
By using our services, you consent to receive communications from us regarding your warranty, claims, and account status through email and SMS (if opted in).
12. State-Specific Provisions
This Service Contract is not available to residents of Florida, Maryland and Washington. The following state-specific amendments apply:
Alabama
- A 10% penalty per month shall be added to refunds not paid within 45 days of return
- Administrative fee is reduced to $25
Alaska
- Reference to "terrorist acts" is removed from exclusions
- Exclusion for consequential damages from collision is removed
- A monthly penalty equal to 10% of the unrefunded amount will be added to a refund that is not paid within 45 days
California
- Modified definition of "Breakdown" to focus on defects in material or workmanship
- 60-day notice required for cancellation by provider
- Administrative fee limited to $25 or 10% of refund amount, whichever is less
- Performance guaranteed by California approved insurance company
Connecticut
- Coverage remains available if contract lapses while vehicle is being repaired
- Established arbitration process for dispute resolution
- 45-day notice required for cancellation by provider
- You may cancel if the Vehicle is returned, sold, lost, stolen, or destroyed
Georgia
- Cancellation refund: 100% of unearned pro-rata price
- Administrative fee limited to $50 or 10% of unearned pro-rata price
- Modified exclusions for modifications and pre-existing conditions
- Claims will not be denied solely because You failed to obtain pre-authorization
Indiana
- Your proof of payment is considered proof of Your payment for this Service Contract
- This Service Contract is not insurance and is not subject to Indiana insurance law
Iowa
- The issuer of this Service Contract is subject to regulation by the Insurance Division
- A 10% penalty will be added each month to a refund that is not paid within 30 days
Louisiana
- This Service Contract is not regulated by the Department of Insurance
- Any concerns should be directed to the Attorney General's office
Massachusetts
- Chapter 90, Section 7N 1/4 of Massachusetts General Laws requires repair shops to provide various disclosures to customers
- Notice of cancellation will be mailed to You within 15 days of the date of cancellation
Michigan
- If performance is interrupted due to a strike or work stoppage, the effective period will be extended accordingly
Minnesota
- A 10% penalty per month must be added to a refund that is not paid within 45 days
- If We cancel this Service Contract, We will mail written notice at least 15 days prior to cancellation
Missouri
- A 10% penalty per month shall be added to a refund that is not paid within 45 days
- If We cancel, notice will be mailed to You within 45 days of the date of cancellation
Nevada
- Contract not automatically suspended if manufacturer's warranty becomes void
- 70-day period for provider cancellation for any reason
- No administrative fee for provider cancellation
- Contract is not renewable
- A 10% penalty per month shall be added to a refund not paid within 45 days
New Hampshire
- In the event You do not receive satisfaction under this Service Contract, You may contact the New Hampshire Insurance Department
- The Insurance Commissioner will be the Service Contract Provider's attorney to receive service of process
New Jersey
- A 10% penalty per month shall be added to a refund not paid within 45 days of return
- If We cancel, We will mail written notice at least 5 days prior to the effective date
New Mexico
- A 10% penalty per 15-day period shall be added to a refund not paid within 60 days
- We may not cancel this Service Contract without providing You with written notice at least 15 days prior
Oklahoma
- This Service Contract is not issued by the manufacturer or wholesale company marketing the product
- Coverage afforded under this Service Contract is not guaranteed by the Oklahoma Insurance Guaranty Association
South Carolina
- A 10% penalty per month shall be added to a refund not paid within 45 days
- If We cancel, We will mail written notice at least 15 days prior to the effective date
Texas
- Unresolved complaints may be directed to the Texas Department of Licensing and Regulation
- 10% penalty per month for refunds not paid within 45 days
- No administrative fee for provider cancellation
- If We cancel this Service Contract, We will mail written notice at least 5 days prior
Utah
- This Service Contract is subject to limited regulation by the Utah Insurance Department
- Coverage will not be denied solely because You failed to obtain pre-authorization
- We can only cancel for material misrepresentation, substantial change in risk, or failure to pay
Wisconsin
- THIS CONTRACT IS SUBJECT TO LIMITED REGULATION BY THE OFFICE OF THE COMMISSIONER OF INSURANCE
- A 10% penalty per month shall be added to a refund not paid within 45 days
- You will be allowed to return this Service Contract within 20 days of mailing or delivery
Wyoming
- A 10% penalty per month shall be added to a refund not paid within 45 days
- If We cancel, We will mail written notice at least 10 days prior to the effective date

13. Insurance Backing
This Service Contract is not an insurance contract. Our obligations under this Service Contract are insured under an insurance policy issued by Virginia Surety Company, Inc., 175 West Jackson Blvd., Chicago, Illinois 60604.
In the event We cease to operate, are bankrupt or Your claim is not paid within sixty (60) days after proof of loss has been filed, You may file a direct claim with Virginia Surety Company, Inc. To do so, please call: 1-800-527-3448.
14. Lender Requirements
If Your Vehicle is financed with Toyota Motor Credit Corporation (TMCC), the following modifications apply to exclusions:
- Vehicle use restrictions are modified for snow plowing if properly equipped by manufacturer
- Towing restrictions apply only when exceeding manufacturer's recommendations
- Modified restrictions on vehicle use for hire or emergency services
15. Modifications
We reserve the right to modify these terms at any time. Continued use of our services after any modifications indicates acceptance of the updated terms.
Authority to Change Terms
- No person has the authority to change this Service Contract or to waive any of its provisions
- No change or amendment to this Service Contract is valid unless it is in writing and signed by an authorized representative of the Administrator
- Any change must comply with all applicable state and federal regulations
Notice of Changes
- Changes to terms will be communicated with at least 30 days notice
- Notice will be provided through email or written communication
- Changes will not affect existing claims or repairs in progress
